Pond Policy — Windover at Hesston

The pond at Windover at Hesston is private property owned and managed by Windover Pond LLC. Access is extended to Windover neighborhood residents and their guests as a courtesy. By accessing or using the pond and its surrounding area, all individuals agree to the terms of this policy in full.

Ownership & Access

The pond is private property owned by Windover Pond LLC. Access is a revocable privilege, not a right.
Access is extended as a courtesy to Windover at Hesston neighborhood residents and their invited guests.
Residents are fully responsible for the conduct and safety of any guests they bring to the pond.
Access is permitted during daylight hours only.
Windover Pond LLC reserves the right to revoke access for any individual at any time and for any reason.

Fishing

Fishing is permitted for residents and their guests at their own risk.
All applicable Kansas state fishing regulations apply. A valid Kansas fishing license is required where mandated by state law.
Please practice catch and release to preserve the health of the pond's ecosystem.
No commercial fishing or trapping of any kind is permitted.
Clean up all fishing line, hooks, and equipment before leaving — discarded tackle is a hazard to wildlife.

Swimming & Watercraft

Swimming in the pond is not permitted. The pond contains a fountain and underwater infrastructure that creates entanglement and drowning hazards.
Non-motorized watercraft such as kayaks or paddleboards may be used at the user's sole risk. No motorized watercraft of any kind are permitted.
Life jackets are strongly recommended for any watercraft use.
Children must be supervised by a responsible adult at all times near the water.

Care & Preservation

No dumping, discharge, or disposal of any substance into or near the pond.
Do not feed waterfowl or wildlife — it disrupts the natural ecosystem and degrades water quality.
No glass containers near the water's edge.
No fires or open flames within 50 feet of the pond.
Leave the area as you found it. Pack out all trash.
Report any water quality concerns, unusual odors, or signs of distress in the pond to Windover Pond LLC promptly.

Disclaimer of Liability

The pond and surrounding area are made available as a courtesy to Windover neighborhood residents and their guests. Use of the pond, its banks, and any adjacent area is entirely at the sole risk of each individual user. Windover Pond LLC, its owners, members, and agents assume no responsibility or liability whatsoever for any injury, illness, death, loss of property, or damage of any kind arising from access to or use of the pond or its surrounding area, regardless of cause. This includes, but is not limited to, slipping, falling, drowning, wildlife encounters, watercraft incidents, and fishing-related injuries. By accessing the pond, each user — and the resident responsible for any guest — expressly accepts and assumes all risk and waives any and all claims against Windover Pond LLC and its owners.

Policy Violations

Violations of this policy should be reported to Windover Pond LLC at hello@windover.net. Windover Pond LLC reserves the right to revoke pond access privileges for any individual who violates this policy, without notice and without obligation to provide a reason.
